HIPAA Notice of Privacy Practices

Effective Date: January 31, 2025

At Prospect Hill Recovery (referred to as “we,” “us,” or “our”), your privacy and confidentiality are entrusted to us with the utmost care. This Notice describes how your Protected Health Information (PHI) may be used or disclosed and how you can exercise your rights under HIPAA and 42 CFR Part 2 (for substance use disorder treatment).

Your Health Information Rights

You have the right to:

  • Request access to and receive a copy of your medical and treatment records
  • Request amendments to your records if inaccurate or incomplete
  • Request restrictions on certain uses and disclosures of your PHI
  • Request confidential communications (e.g., alternate contact methods)
  • Receive an accounting of disclosures of your PHI
  • Withdraw consent or authorization when permitted and in writing
  • File a complaint with us or with the U.S. Department of Health and Human Services if you believe your privacy rights have been violated.

How We May Use and Disclose Your PHI

Without your written consent, we may use or disclose your PHI for the following purposes:

  • Treatment: Coordination and provision of care among our clinical team and referral partners
  • Payment: Insurance billing or verification, with your signed authorization
  • Healthcare Operations: Quality assurance, audits, accreditation, licensing, and clinical improvement
  • Legal & Public Health: Disclosures required by law, court orders, or public health authorities
  • Emergencies: If someone’s health or safety is at risk
  • Business Associates: Third-party vendors who support our operations under HIPAA-compliant agreements
  • Research & Oversight: As permitted by law for research or care oversight purposes.

We will never sell your PHI or use it for marketing or advertising without your explicit, written authorization.

Substance Use Disorder Records – 42 CFR Part 2

Records relating to substance use treatment are subject to additional federal protections under 42 CFR Part 2, which limits disclosure:

  • We will not disclose such records unless:
    • You provide clear written consent, or
    • A valid court order permits disclosure, or
    • There’s a medical emergency or authorized internal quality purposes.

Safeguarding Your Information

We protect your privacy through administrative, physical, and technical safeguards aligned with HIPAA standards. Our team—including clinicians and staff—works within these protocols to ensure confidentiality, particularly for individuals in high-profile or sensitive circumstances.
